By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website.

3. The Online Sales Process

Our website showcases products and facilitates custom quote requests. A legally binding contract of sale is formed only when you have accepted a formal quote, completed payment, and received a written order confirmation from MintPrint.

  • Pricing: All prices for quotes will be provided in South African Rand (ZAR). Prices for custom work are finalized via a formal quote. We are not currently registered for Value-Added Tax (VAT).
  • Payment: Accepted payment methods will be detailed on your formal quote (e.g., Electronic Funds Transfer (EFT)).
  • Payment Security: For payments made via EFT, please ensure you are using the correct bank details as provided on our official quote. We are not responsible for payments made to incorrect accounts.

4. Fulfillment, Shipping, and Delivery

As our products are custom-made, order processing times are essential.

  • Fulfillment: We will provide an estimated production time with your quote. This is typically 5-7 business days but may vary based on the order's complexity.
  • Delivery: Delivery timeframes and costs will be clearly stated on your quote, based on your location and chosen delivery method (e.g., courier, local pickup).

5. Returns, Refunds, and the Cooling-Off Period

We are committed to providing high-quality products. If your product is defective or not as specified in your confirmed order, please contact us within 48 hours of receipt to arrange a replacement or refund.

Important Notice on Cooling-Off Period: Under Section 44 of the ECTA, consumers normally have a seven-day "cooling-off" period for electronic transactions.

However, this right does **not** apply to transactions for goods that are "made to the consumer's specifications" or are "clearly personalized". As all MintPrint products are custom-made and personalized to your specific request, they are exempt from the seven-day cooling-off period. All sales are final once production has begun.

6. Intellectual Property and Acceptable Use

All content on this Website, including the MintPrint logo, text, graphics, and designs, is the intellectual property of MintPrint and is protected by South African and international copyright laws.

You may not use, reproduce, or distribute any content from this Website without our prior written permission. You agree to use this Website for lawful purposes only and not in a way that infringes on the rights of, or restricts the use of, this Website by any third party.

7. Limitation of Liability

This Website and its content are provided "as is". While we strive to ensure all information is accurate, we make no warranties, express or implied, regarding the Website's operation or the information, content, or materials included.

To the fullest extent permissible by law, MintPrint disclaims all warranties and will not be liable for any damages of any kind arising from the use of this Website.

3. Personal Information We Collect and Why

We collect only the minimum information necessary to provide our services. We collect information in the following ways:

    • Where: When you fill out the form on our contact page.
    • Purpose: To respond to your inquiries, provide custom quotes, and communicate with you about your order.
    • Lawful Basis (POPIA): "Consent" and "Necessary to take steps to enter into a contract".
  • Indirectly Collected Information: This is technical data collected automatically when you browse our site.
    • What: Your IP Address, browser type, and device information.
    • Purpose: For website security, to monitor website performance, and to improve user experience.
    • Lawful Basis (POPIA): "Legitimate Interest" (for security) and "Consent" (for non-essential analytics cookies).

4. Disclosure to Third Parties & International Transfers

We do not sell your personal information. However, to provide our services, we use third-party "Operators" who process data on our behalf.

By using our website and services, you acknowledge and agree that your personal information may be transferred to, stored, and processed on servers located outside of South Africa. We confirm that these transfers are lawful and secure.

Our key Operators include:

  • Meta Platforms, Inc. (WhatsApp): When you contact us via WhatsApp, your phone number and message history are processed by Meta. This data is transferred to their global servers (e.g., in the USA).
  • Google LLC (Google Sheets): Our website's product information is managed using the Google Sheets API. This data is processed by Google on its global servers.

5. Data Security and Breach Protocol

We take the security of your personal information seriously and implement "appropriate, reasonable technical and organisational measures" to protect it against loss, damage, or unauthorized access.

While our website is currently in a development environment, we are committed to migrating to a secure, production-grade hosting provider to ensure POPIA compliance.

In the unlikely event of a data breach, we will notify the Information Regulator and affected data subjects as soon as reasonably possible, as required by law.

6. Data Retention

We will not retain your personal information for longer than is necessary for the purposes it was collected for.

  • Contact & Quote Information: Retained for 2 years after our last contact to manage follow-up inquiries.
  • Transaction Records: If you become a customer, transaction records will be retained for a minimum of five years to comply with tax regulations.

Under POPIA, you have the right to:

  • Right to Access: Request a copy of the personal information we hold about you.
  • Right to Correction: Request the correction of any inaccurate or outdated information.
